CASH ON DELIVERY (C.O.D) – TERMS, LIMITATIONS & ENFORCEMENT
1. Conditional Availability
Cash On Delivery (C.O.D) is reintroduced by GloEPoint WorldMart strictly at the sole discretion of Management. The availability of C.O.D may be limited to selected products, members, locations, or delivery partners, and may be withdrawn, suspended, or modified at any time without prior notice.
C.O.D applies only to regular purchases and is explicitly excluded for any special promotions, exclusive offers, discounts, or bundled campaigns
2. Member-Only & Eligibility Control
C.O.D is not a guaranteed payment option and is only extended to eligible members who meet internal risk assessment criteria. GloEPoint WorldMart reserves full rights to approve, restrict, blacklist, or permanently revoke C.O.D access for any customer, member, or user without obligation to provide justification.
3. Binding Purchase Commitment
By selecting C.O.D for pembelian biasa, the customer irrevocably confirms and commits to accepting and paying for the order upon delivery.
Refusal to accept delivery without valid, proven fault attributable to GloEPoint WorldMart or its logistics partner shall be treated as a breach of purchase obligation.
4. Non-Acceptance, Fake Orders & Abuse
Any act including but not limited to:
* Refusing delivery without lawful justification
* Providing false, unreachable, or misleading delivery details
* Ordering without intent to pay
* Repeated cancellations or non-collection
* Attempting to evade payment responsibility
shall constitute C.O.D abuse, and may result in:
* Immediate account suspension or termination
* Permanent C.O.D ban
* Blacklisting across GloEPoint-affiliated platforms
* Forfeiture of rewards, cashback, points, or privileges
* Legal recovery of losses, delivery fees, and administrative costs
5. Delivery Attempt & Deemed Acceptance
A delivery attempt made in good faith by the assigned courier shall be deemed valid.
Failure to respond, be present, or accept delivery after such attempt may be treated as constructive refusal, with all related losses chargeable to the customer.
6. No Obligation to Reattempt Delivery
GloEPoint WorldMart is not obligated to reschedule, reattempt delivery, or convert C.O.D orders into prepaid orders once refusal or non-acceptance occurs.
7. Fees, Loss Recovery & Enforcement Rights
GloEPoint WorldMart reserves the right to:
* Impose handling, delivery, restocking, or penalty fees
* Offset losses against any existing balances, rewards, or credits
* Engage logistics partners, debt recovery agents, or legal channels where applicable
* Use internal data to assess fraud risk and enforce platform protection
8. No Refund, No Compensation
No refunds, compensation, or claims shall arise from:
* C.O.D suspension or removal
* Order cancellation due to risk control
* Refusal consequences
* Platform enforcement actions
9. Final Authority & Legal Protection
All determinations relating to C.O.D eligibility, abuse, enforcement, and penalties are final and binding as decided by GloEPoint WorldMart Management.
This clause shall be enforced to the maximum extent permitted under the laws of Negara Brunei Darussalam, without prejudice to GloEPoint WorldMart’s other rights and remedies.
1. INTRODUCTION
1.1 These Terms & Conditions (“T&C”) govern the use of services, purchases, transactions, and other interactions related to GloEPoint Worldmart, including but not limited to online or offline purchases, reservations, deliveries, promotions, rewards, and claim resolutions.
1.2 By making a purchase, placing a reservation, using the services, or interacting with GloEPoint Worldmart in any form, you are deemed to have read, understood, and agreed to be bound by all these terms and conditions. If you do not agree with these T&C, you are not allowed to make purchases or use GloEPoint Worldmart services.
1.3 These T&C apply to all customers including members and non-members, as well as any party that uses the services or purchases products from GloEPoint Worldmart, regardless of the method of purchase or platform used.
1.4 These T&C apply to all customers who place orders and purchases, whether online or offline, including through official platforms, official social media, WhatsApp, phone calls, or purchases at physical stores. All orders are subject to confirmation, stock availability, and compliance with these T&C.
1.5 In the event of any conflict between these T&C and any promotion, offer, or other terms, these T&C will prevail and be the main reference, unless otherwise stated in writing by GloEPoint Worldmart.
1.6 GloEPoint Worldmart reserves the right to reject or cancel orders, cancel memberships, or take appropriate actions if customers are found to violate these T&C, including but not limited to abuse, fraud, or actions that harm GloEPoint Worldmart.
2. DEFINITIONS
2.1 “Customer” refers to all individuals, companies, organizations, or other entities that make purchases, orders, or use GloEPoint Worldmart services, whether online or offline, including non-members and members. This also includes any party acting on behalf of other customers.
2.2 “Member” refers to users who register as GloEPoint members through the official platform and have received membership confirmation from GloEPoint. Membership is subject to these T&C, policies, and evaluation by GloEPoint Worldmart.
2.3 “Regular Purchase” refers to the purchase of products at a fixed price (regular price) set by GloEPoint Worldmart, without any discounts or special promotions, unless clearly stated in a valid advertisement or offer.
2.4 “Special Promotion” refers to any promotion or offer conducted within a specific period, including but not limited to discounts, bundles, promotional prices, special offers, vouchers, cashback, or any other form of incentive offered by GloEPoint Worldmart. Special promotions are subject to additional terms stated in the promotion and may be changed or canceled without notice.
2.5 “Price” refers to the price displayed on the official GloEPoint Worldmart platform, or the price stated during booking/purchase. Prices are subject to confirmation, technical errors, price changes, and stock availability. In case of pricing errors, GloEPoint Worldmart reserves the right to cancel orders or request additional payment.
2.6 “Product” refers to goods, services, or other items sold or offered through GloEPoint Worldmart, including physical products, digital products, and third-party services sold through this platform.
3. MEMBERSHIP & ACCOUNT USAGE
3.1 Members are responsible for ensuring that registration information is correct, accurate, and up to date. Members are also responsible for maintaining the confidentiality of passwords, account numbers, and login information. GloEPoint Worldmart is not responsible for any losses or claims arising from account usage by third parties due to member negligence or disclosure of login information.
3.2 GloEPoint Worldmart reserves the right to reject, suspend, or cancel membership if there is fraud, misuse, or violation of the T&C. This includes but is not limited to:
* misuse of rewards or cashback
* purchases for commercial purposes that violate the T&C
* use of multiple accounts to gain unauthorized benefits
* identity fraud or false registration
* any actions that harm GloEPoint Worldmart or other customers.
3.3 Member accounts may not be transferred, leased, or used by third parties without written permission from GloEPoint Worldmart. Any account transfer, account sharing, or use by third parties without written permission will be considered a violation of the T&C and may result in account cancellation as well as cancellation of rewards or cashback earned.
3.4 GloEPoint Worldmart reserves the right to cancel accounts or access if there is suspicious activity or misuse. GloEPoint Worldmart also reserves the right to block, suspend, or cancel transactions, rewards, or cashback if there is evidence or suspicion of unauthorized or high-risk activity. GloEPoint Worldmart’s decision is final and effective without further notice.
3.5 GloEPoint Worldmart reserves the right to change, add, or amend membership terms from time to time. Members are deemed to accept the changes when using the account or making purchases after the changes are announced or displayed officially.
4. PURCHASES & PAYMENTS
4.1 All purchases are subject to current stock and product availability. GloEPoint Worldmart does not guarantee that products will always be available. Purchases are only considered valid after the order is confirmed by GloEPoint Worldmart.
4.2 The displayed price includes taxes (if any), unless stated otherwise. Prices are based on the current display and may change according to tax changes, subsidy rates, or changes in government policy. GloEPoint Worldmart is not responsible for any price changes caused by authorities or changes in law.
4.3 Payment must be made through the methods provided on the platform or as stated by GloEPoint Worldmart. Payments through methods other than those stated are invalid and will not be processed. GloEPoint Worldmart is not responsible for any losses or claims if customers make payments to parties other than the official methods.
4.4 GloEPoint Worldmart reserves the right to reject or cancel orders if there is doubt about the payment or fraud. This includes but is not limited to: incomplete payments, fake payments, payments using accounts or cards belonging to third parties without authorization, or any suspicious activity.
4.5 Price Errors / Typo
If there is a price error (e.g., an unreasonable price due to system or human input), GloEPoint Worldmart reserves the right to cancel the order and refund the payment if payment has been made. GloEPoint Worldmart also reserves the right to offer other options such as confirming the correct price, canceling the order, or offering an alternative offer, at GloEPoint Worldmart’s discretion.
4.6 Price Changes
Prices may change without notice and customers will be informed if the price changes after the order is made. If a price change occurs after the order is made, GloEPoint Worldmart reserves the right to:
* reconfirm the order at the latest price, or
* cancel the order and refund the payment, or
* offer a suitable alternative solution.
GloEPoint Worldmart’s decision is final and bound by internal policies and current stock conditions.
4.7 Order Validity
Orders are considered valid and effective only after payment is confirmed received by GloEPoint Worldmart. GloEPoint Worldmart is not responsible for any losses or claims arising from unconfirmed orders or failed payments.
5. REGULAR PURCHASE
5.1 Regular Purchases are subject to the standard price displayed.
The standard price is based on the current display and may change according to market adjustments, supplier costs, or internal policy changes of GloEPoint Worldmart. GloEPoint Worldmart does not guarantee that the standard price will remain the same for a certain period.
5.2 Stock and prices may change without prior notice depending on suppliers and market conditions.
GloEPoint Worldmart is not responsible for any losses, claims, or damages arising from stock or price changes without prior notice. Customers are advised to make purchases based on current availability.
5.3 Regular Purchases are not eligible for special promotions unless stated otherwise.
If any promotion or discount is applied unintentionally to a regular purchase, GloEPoint Worldmart reserves the right to correct the price and/or cancel the order, at GloEPoint Worldmart’s discretion.
5.4 Stock Availability
Stock is subject to availability and may change without notice.
GloEPoint Worldmart reserves the right to cancel orders if stock is insufficient. Payments will only be refunded if the product is truly out of stock and cannot be fulfilled, unless otherwise stated by GloEPoint Worldmart.
If stock is still in transit or awaiting arrival from suppliers, customers agree that payments will not be refunded and the order will proceed according to the timeframe set by GloEPoint Worldmart.
GloEPoint Worldmart is not responsible for any claims or losses due to delivery delays caused by stock shortages or supplier issues.
5.5 Order Confirmation
Regular purchase orders are considered valid only after order confirmation is made by GloEPoint Worldmart.
If the order is not confirmed or is canceled, GloEPoint Worldmart will refund the payment via the original payment method (if applicable) and is not responsible for other claims.
6. SPECIAL PROMOTIONS
6.1 Special Promotions are subject to the promotion terms stated.
Each special promotion may have additional conditions such as validity period, limited quantity, specific products, and purchase limits. These additional conditions will be stated during the promotion and are considered part of these T&C.
6.2 GloEPoint Worldmart reserves the right to change, terminate, or cancel promotions at any time without notice.
Changes or cancellation of promotions do not entitle customers to claim compensation, damages, or legal action. If a promotion is canceled, customers are only eligible for solutions set by GloEPoint Worldmart such as order cancellation or other alternative options.
6.3 If special promotions involve quantity limits, purchases will be limited to the set amount.
GloEPoint Worldmart reserves the right to reject, cancel, or partially cancel orders if customers exceed the set quantity limit. GloEPoint Worldmart’s decision is final.
6.4 If there are pricing errors or promotional errors (e.g., unreasonable prices or system errors), GloEPoint Worldmart reserves the right to cancel orders and refund the money (if already paid) or offer other solutions.
GloEPoint Worldmart is not responsible for any losses or claims arising from pricing or promotional errors, including indirect losses, loss of opportunity, or additional costs.
6.5 Promotions are subject to “first come first serve” terms and promotions are invalid if misused or fraudulently used.
If there is evidence of fraud or abuse of promotions (e.g., use of multiple accounts, unreasonable repeated purchases, or use of fake identities), GloEPoint Worldmart reserves the right to:
* cancel orders,
* block accounts,
* cancel rewards/promotions, and
* take legal action if necessary.
6.6 Special Promotions are final and not eligible for reclaims if customers change their minds, except if the item is damaged or wrongly delivered.
Special promotions are special offers and cannot be exchanged or reclaimed after purchase. Any exchanges or returns will only be considered according to the return policy set and subject to confirmation by GloEPoint Worldmart.
7. DELIVERY & RECEIPT
7.1 Delivery will be made according to the method and time stated during purchase.
However, delivery times are estimates and not guaranteed. GloEPoint Worldmart is not responsible for any delays that occur even after order confirmation has been made.
7.2 GloEPoint Worldmart is not responsible for delays caused by third parties (courier, disasters, logistics issues).
This includes delays caused by courier parties, unexpected delivery issues, congestion, operational errors, or other external factors.
7.3 Customers are responsible for inspecting items upon receipt.
Any damage, discrepancies, or other issues must be reported within 24 hours after receipt.
Reports made after this period will not be entertained unless there is strong evidence or special consideration by GloEPoint Worldmart.
7.4 Force Majeure
GloEPoint Worldmart is not responsible for delivery delays or failures due to natural disasters, pandemics, logistics disruptions, strikes, government actions, border restrictions, or factors beyond control.
7.5 Address & Delivery Errors
Customers are responsible for ensuring the delivery address is correct and complete.
If a wrong address causes delivery failure or additional costs, customers must bear the cost of re-delivery or additional costs charged by the courier.
GloEPoint Worldmart reserves the right to cancel orders if the address is incomplete or invalid.
7.6 Lost Package / Delivered Status
If the courier states that the order has been delivered but the customer claims not to have received it, the customer must make a claim with the courier first.
GloEPoint Worldmart will assist in the investigation process but is not responsible for the courier’s decision or losses that occur after handover.
7.7 Inspection Upon Receipt
If items are damaged or incomplete, customers must refuse acceptance and report to GloEPoint Worldmart within 24 hours.
If customers accept damaged items and still sign the receipt without making an initial report, GloEPoint Worldmart reserves the right to reject the claim.
7.8 Delivery Responsibility
GloEPoint Worldmart is not responsible for damage or loss that occurs after items are handed over to the courier.
All risks of loss or damage after handover are the responsibility of the customer and/or the courier.
8. RETURNS & CLAIMS
8.1 Damaged items, wrong items, or items not received will be handled according to the return policy.
GloEPoint Worldmart reserves the right to determine whether the item is eligible for return based on the evidence provided by the customer and internal assessment. GloEPoint Worldmart’s decision is final.
8.2 Items that have been used, damaged due to usage, or incomplete are not eligible for return.
If the item has been opened or used, customers must ensure the item is in its original and complete condition for any return consideration. If not, the return will not be approved.
8.3 Return policy is subject to the product type and conditions stated at the time of purchase.
Some products have different return conditions and can only be returned if they meet the conditions stated at the time of purchase.
8.4 Return claims must be made within 24 hours after receiving the item.
Reports after this period will not be entertained unless there is strong evidence or special consideration from GloEPoint Worldmart.
8.5 Return shipping for items that are not damaged or not wrongly delivered is the responsibility of the customer (unless stated otherwise).
Customers are responsible for bearing the return shipping costs for items that are not due to GloEPoint Worldmart’s fault, unless stated otherwise.
8.6 Refund Processing
Return and refund processing will be done within 30 working days after confirmation.
GloEPoint Worldmart is not responsible for any additional delays caused by banks, financial institutions, or third parties.
8.7 Non-Returnable Products
Products such as food, beverages, health products, cosmetics, products that have been opened, or damaged due to usage are not eligible for return unless there is manufacturing damage or wrong delivery.
If the product is damaged or wrongly delivered, customers must provide clear evidence such as photos or videos for consideration.
8.8 No Refund
GloEPoint Worldmart does not provide refunds for purchases made, except in the following circumstances (provided the claim is made within 24 hours after receipt and clear evidence is provided):
a) Product not received / lost (after investigation is conducted and confirmed by GloEPoint Worldmart).
b) Product damaged during delivery (with clear evidence).
c) Wrong product delivered (with clear evidence).
d) Product truly out of stock and the order cannot be fulfilled (unless stated otherwise by GloEPoint Worldmart).
GloEPoint Worldmart reserves the right to offer product replacement, store credit, or alternative solutions as compensation, at GloEPoint Worldmart’s discretion.
9. REWARD, CASHBACK & POINTS
9.1 Rewards, cashback, or points earned through GloEPoint Worldmart are not cash and cannot be converted into cash unless clearly stated.
Rewards, cashback, or points are internal rewards and can only be used for purchases or activities allowed by GloEPoint Worldmart.
9.2 Rewards/points cannot be transferred, sold, or exchanged to third parties.
Any transfer or sale of rewards/points without written permission from GloEPoint Worldmart is prohibited and will result in reward cancellation and further action including account blocking.
9.3 Rewards/points may expire within the period set by GloEPoint Worldmart.
The expiry date of rewards will be displayed in the customer’s account or in the promotion terms. GloEPoint Worldmart is not responsible if customers fail to use the rewards before the expiry date.
9.4 GloEPoint Worldmart reserves the right to cancel, reject, or withdraw rewards/points if there is suspicion of fraud or abuse.
This includes but is not limited to: use of multiple accounts, system manipulation, unreasonable repeated purchases, or any activity intended to gain rewards unlawfully.
9.5 Rewards/points are only eligible for purchases that meet promotion conditions. Certain promotional purchases or discounted purchases may not be eligible to receive rewards/points.
GloEPoint Worldmart reserves the right to designate certain products, categories, or promotions that are not eligible for rewards/points.
9.6 Any disputes regarding rewards/points must be made within 7 days after crediting. After this period, GloEPoint Worldmart’s decision is final.
Disputes made later than this period will not be entertained, unless there is special consideration from GloEPoint Worldmart.
9.7 GloEPoint Worldmart is not responsible for loss of rewards/points due to technical disruptions, system maintenance, or third-party errors.
GloEPoint Worldmart reserves the right to fix, correct, or restore rewards at its discretion, but is not obliged to do so.
9.8 Fraud Prevention
GloEPoint Worldmart reserves the right to block accounts, cancel rewards, or take legal action if there is abuse or fraud.
GloEPoint Worldmart also reserves the right to cancel or withhold rewards if there is inconsistency or suspicion of unauthorized activity, without the need to provide prior notice.
9.9 GloEPoint Worldmart’s Absolute Rights
GloEPoint Worldmart has the absolute right to change, suspend, or cancel the rewards/cashback/points program at any time without notice.
Such changes do not entitle customers to claim compensation or damages.
10. PRIVACY & SECURITY
10.1 Legal Compliance
GloEPoint Worldmart complies with all laws, regulations, and guidelines related to personal data protection and privacy that are in force in the country where we operate, including but not limited to data enforcement, information protection, and cyber security.
10.2 Use of Customer Information
Customer information will only be used for the purposes of order processing, delivery, troubleshooting, customer service, as well as official communications related to transactions and customer accounts. GloEPoint Worldmart will not use customer data for other purposes without clear and valid consent from the customer.
10.3 Disclosure to Third Parties
GloEPoint Worldmart has the absolute right and authority to disclose, transfer, or share the information of any customer, member, non-customer, visitor, or any related party (“User”) with third parties without requiring further consent from the User if such disclosure is necessary for compliance with the law, court orders, directives from competent authorities, or for business operations including but not limited to delivery, service providers, strategic partners, technical vendors, internal audits, system security, fraud prevention, abuse detection, or the protection of the rights, interests, reputation, and security of GloEPoint Worldmart, GloEPoint, its management, employees, and business partners. The User hereby acknowledges and agrees that any third party receiving such information is bound by confidentiality and security obligations equivalent to or stricter than those of GloEPoint Worldmart. The User fully waives any rights to claim, challenge, request internal disclosure, compliance documents, licenses, registration details, third-party contract information, or any confidential information related to the management, business, or legal compliance of GloEPoint Worldmart, except as expressly required by applicable law.
10.4 Marketing Data
By making a purchase or registering as a customer, customers give consent to receive marketing and promotional communications via SMS, WhatsApp, email, or other lawful communication channels. Customers may opt-out at any time through the provided link or through official channels.
Important Note: Even if customers opt-out, GloEPoint Worldmart still reserves the right to send official communications related to transactions, order status, account security, and other important notifications.
10.5 Data Retention Period
Customer information will be stored for the period required to:
(a) process orders and fulfill contractual obligations;
(b) audit, financial, and legal compliance purposes;
(c) security, fraud prevention, and dispute resolution purposes.
GloEPoint Worldmart reserves the right to retain customer data for a longer period if required by law or to meet security investigation requirements. Customers may request data deletion through official channels, but such requests are subject to legal requirements and data retention obligations that remain in force.
10.6 Data Security
GloEPoint Worldmart uses industry-standard security measures to protect customer data, including technical measures and administrative procedures. However, customers understand and accept that no security system can guarantee absolute protection against unauthorized access, cyber attacks, disruptions, or data leaks by third parties.
GloEPoint Worldmart is not responsible for any losses or claims arising from security incidents that are beyond our reasonable control, unless caused by gross negligence or direct misconduct by GloEPoint Worldmart.
10.7 GloEPoint Worldmart / GloEPoint’s Right to Request Information
GloEPoint Worldmart and GloEPoint reserve the right to request any information or documents from customers/members, including but not limited to proof of purchase, member codes, account numbers, or other supporting documents, for the purposes of verification, reference, investigation, or dispute resolution. Customers/members are required to provide such information when requested to enable GloEPoint Worldmart to carry out legitimate and reasonable processes.
11. DISCLAIMER & LIMITATION OF LIABILITY
11.1 “As Is” Products
GloEPoint Worldmart provides products and services on an “as is” and “as available” basis, without any warranties except those expressly stated in this document or required by law.
11.2 No Warranty
Unless expressly stated in writing, GloEPoint Worldmart provides no warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose, quality, usability, accuracy, safety, or reliability of products and services.
11.3 Product Use
Customers are fully responsible for using products according to the instructions, warnings, and specifications provided by the manufacturer or supplier. GloEPoint Worldmart is not responsible for any damage, injury, accident, or loss arising from incorrect, improper, or unauthorized use of products.
11.4 Third-Party Products
For products supplied by third parties or external suppliers, GloEPoint Worldmart is not responsible for any manufacturing defects, quality, accuracy of information, or other issues related to those products, unless otherwise expressly stated in writing. All claims related to third-party products should be referred to the relevant supplier or manufacturer.
11.5 Limitation of Liability
To the extent permitted by law, GloEPoint Worldmart’s liability is limited to the amount paid by the customer for the purchased product or service involved. This includes any costs, charges, or fees paid by the customer to GloEPoint Worldmart.
11.6 Exclusion of Indirect Losses
GloEPoint Worldmart is not responsible for any indirect losses, special losses, incidental losses, loss of profits, loss of revenue, loss of business opportunities, additional costs, or other losses arising indirectly from the use, inability to use, or quality of products.
11.7 Limitation of Claims
Customers cannot claim compensation exceeding the amount paid for the product, even if the claim is based on contract, tort, law, or other theories. This limit also includes any claims related to product quality, damage, or loss.
11.8 Exclusion of Invalid Claims
GloEPoint Worldmart will not be responsible for any claims arising from product misuse, improper use, product modification, or using products for unintended purposes.
12. FRAUD & ABUSE
12.1 Actions Against Fraud & Abuse
GloEPoint Worldmart reserves the right to take any action deemed reasonable and necessary, including but not limited to blocking or suspending accounts, canceling or rejecting orders, withholding delivery, blocking access to services, rejecting applications, or initiating legal action against customers or third parties involved in fraud, abuse, manipulation, or activities that harm GloEPoint Worldmart or other users.
12.2 Unauthorized Representation
If any party claims to be a representative of GloEPoint Worldmart without authorization, customers are required to immediately contact the official GloEPoint Worldmart hotline to report the incident. GloEPoint Worldmart reserves the right to take further action against the party according to the law.
12.3 Impersonation Warning
GloEPoint Worldmart only uses official phone numbers and official social media listed on the company’s official channels. Any communication, message, call, or request received from other numbers or platforms is invalid and does not represent GloEPoint Worldmart.
GloEPoint Worldmart is not responsible for any losses, damages, or claims arising from such unauthorized communications, including but not limited to fraud, loss of money, or misuse of personal information.
12.4 Evidence & Records
Order records, system logs, transaction records, call records, WhatsApp chat records, emails, and other evidence stored by GloEPoint Worldmart are considered valid and final, and can be used as evidence in dispute resolution, internal investigations, or legal actions.
Customers acknowledge that these records are accurate and binding, unless customers can prove otherwise with valid evidence.
13. INDEMNITY (CUSTOMER LIABILITY)
13.1 Customer Indemnity
Customers agree to indemnify, defend, and hold harmless GloEPoint Worldmart, GloEPoint, and any parent company, subsidiaries, agents, representatives, directors, employees, and business partners (collectively referred to as “Related Parties”) from any claims, actions, losses, liabilities, costs, expenses, legal fees, and damages (including but not limited to direct, indirect, or consequential losses) arising directly or indirectly from:
(a) misuse, improper use, or use that violates instructions of the products;
(b) misuse of products or services;
(c) breach of these Terms & Conditions by the customer;
(d) customer’s failure to keep account information and passwords secure;
(e) any actions or negligence by the customer that cause loss to third parties;
(f) claims related to fraud, impersonation, or abuse involving the customer’s account.
13.2 Customer Responsibility for Third-Party Claims
Customers agree to be fully responsible and pay all costs, losses, and claims imposed by third parties arising from the customer’s use of products or services, including but not limited to claims of injury, accidents, property damage, copyright infringement, trademark infringement, or other legal violations.
Customers also agree to fully cooperate with GloEPoint Worldmart in any related investigations or proceedings, including providing necessary information and documents.
13.3 Notice Requirement and Case Control
GloEPoint Worldmart reserves the right to fully control any settlement, negotiation, or defense for claims involving indemnity, and customers agree to provide full cooperation. Customers may not settle or admit guilt on behalf of GloEPoint Worldmart without prior written permission.
13.4 Customer Negligence & Social Media Content
Customers acknowledge that it is their responsibility to read, understand, and comply with the Terms & Conditions before making a purchase. Customers’ failure to read or understand the Terms & Conditions is their own negligence, and customers may not claim exemption or cancellation of rights based on such misunderstanding.
Customers also agree that GloEPoint Worldmart, GloEPoint, and any parent company, subsidiaries, agents, representatives, directors, employees, and business partners (collectively referred to as “Related Parties”) are free from any claims, losses, liabilities, costs, or legal actions arising from any sharing, posting, reviews, or viral content on social media made by customers or third parties related to the products, services, or customer experience.
14. THIRD-PARTY & PLATFORM SERVICES
14.1 Third-Party Services
GloEPoint Worldmart uses third-party services including but not limited to couriers, payment service providers, e-commerce platforms, system providers, software suppliers, and other business partners (“Third Parties”). Customers acknowledge that the use of these services is to facilitate operations and delivery, and does not constitute a direct guarantee or endorsement by GloEPoint Worldmart of every aspect of the third-party services.
14.2 Exclusion of Liability for Third Parties
GloEPoint Worldmart is not responsible for any failures, delays, loss, damage, additional costs, or other losses caused by the actions or negligence of Third Parties, including but not limited to:
(a) delivery delays or loss of goods by the courier;
(b) payment system failures or disruptions;
(c) technical issues, network disruptions, or failures of third-party platforms;
(d) fraudulent actions or misuse by third parties;
(e) any additional costs arising from the use of third-party services.
14.3 System Disruptions & Maintenance
In the event of system disruptions, maintenance, updates, or technical issues on the GloEPoint Worldmart platform or third-party systems, GloEPoint Worldmart reserves the right to suspend, cancel, or modify orders, promotions, or offers without prior notice.
GloEPoint Worldmart also reserves the right to restrict access, suspend services, or change platform functions for security, maintenance, or system improvement purposes.
14.4 Third Parties Control Services
Customers acknowledge that any terms, policies, or conditions of use set by Third Parties (for example couriers or payment providers) apply and customers are responsible for complying with those terms.
GloEPoint Worldmart is not responsible for any claims or disputes arising between customers and Third Parties.
15. PRICE CONTROL / SUBSIDY DISCLAIMER
15.1 Price Control & Subsidy Regulations
The prices of products sold by GloEPoint Worldmart are subject to price control regulations, subsidies, and government policies in force in the country where we operate (if applicable). The prices displayed on the platform are in accordance with the permitted prices and updated according to the applicable regulatory conditions.
15.2 Price Changes Due to Government Policies
GloEPoint Worldmart is not responsible for any price changes, subsidy replacements, or changes in pricing structure caused by government decisions, policy changes, official announcements, or the reinstatement of subsidies. Such changes are beyond the control of GloEPoint Worldmart.
15.3 Subsidy Issues Under Regulatory Authority
Any issues related to subsidies, subsidy eligibility, compliance with subsidy conditions, or disputes related to subsidies are under the regulation of the relevant authorities and are not the responsibility of GloEPoint Worldmart.
GloEPoint Worldmart reserves the right to modify, change, or cancel subsidy-related promotions at any time without notice if required to comply with regulations and directives of the authorities.
15.4 Price Confirmation & Customer Responsibility
Customers are responsible for understanding and accepting that the displayed prices are subject to change and do not guarantee that the prices will remain the same for a certain period. GloEPoint Worldmart is not responsible for any claims or disputes arising from price changes caused by government regulations or subsidies.
16. AMENDMENT OF TERMS
16.1 Right to Amend Terms & Conditions
GloEPoint Worldmart reserves the right to amend, modify, add, or remove any part of these Terms & Conditions at any time without prior notice, subject to applicable rules and laws.
16.2 Effect of Changes and Notice
Changes to the Terms & Conditions will take effect immediately after being displayed on the official GloEPoint Worldmart platform or officially notified through official communication channels such as the website, official social media, email, or official WhatsApp.
Customers are responsible for checking the Terms & Conditions periodically to ensure they understand the changes made.
16.3 Agreement to New Terms
Continued use by customers after changes to the Terms & Conditions is considered acceptance and agreement to the amended terms.
If customers do not agree with the changes, customers are required to stop using the services and/or making purchases immediately.
16.4 Still Bound Even If Not Read
Customers acknowledge and agree that they remain bound by the amended Terms & Conditions even if they do not read or are not aware of the changes, and cannot claim exemption based on misunderstanding or lack of knowledge of the changes.
17. DISPUTE RESOLUTION & EVIDENCE
17.1 Initial Negotiation
Any disputes, claims, or complaints arising from the use of GloEPoint Worldmart services or purchase of products must be resolved through amicable negotiation directly between the customer and GloEPoint Worldmart first.
17.2 Referral to Court
If negotiation does not reach a resolution within a reasonable period, the dispute may be brought to the relevant court according to the applicable laws and jurisdiction.
17.3 Time-Bar
Any claim or dispute must be brought within 14 days after receiving the goods or after the issue arises, whichever is earlier. After this period, customers are deemed to have accepted the condition of the goods/services and waive any rights to make claims related to the issue, unless otherwise required by applicable law.
17.4 Evidence & Records
CCTV recordings, order logs, transaction logs, WhatsApp chat records, emails, system logs, and other evidence kept by GloEPoint Worldmart are considered valid, final, and binding, and may be used as evidence in dispute resolution, internal investigations, or legal action.
Customers acknowledge that such records are accurate unless customers can prove otherwise with valid evidence.
17.5 Rejection of Excessive Claims
Customers may not submit excessive, repeated, or unreasonable claims against GloEPoint Worldmart. GloEPoint Worldmart reserves the right to reject claims that are not supported by sufficient evidence or that are not made within the specified period.
17.6 Viral Content & Legal Action
Any sharing, posting, reviews, comments, or viral content on any social media platform related to GloEPoint Worldmart, GloEPoint, or any related parties, including by customers, members, or third parties who have not made purchases, may result in legal action.
GloEPoint Worldmart, GloEPoint and any parent companies, subsidiaries, agents, representatives, directors, employees, and business partners (collectively referred to as “Related Parties”) have the right to take legal action against any party who spreads such content, regardless of whether the statement is true or not, if the content is considered damaging to reputation, harmful to business, or affecting the operations of GloEPoint Worldmart.
The party uploading such content will be fully responsible for all costs, losses, and legal actions arising from the content.
17.7 Peaceful Dispute Resolution & Through Official Channels
Customers and third parties are required to resolve any disputes peacefully through GloEPoint Worldmart’s official channels only, such as the official hotline, official email, or the company’s official platforms.
Any actions of spreading allegations, slander, or disputes publicly through social media, WhatsApp groups, forums, or any other public channels are not allowed and may result in legal action.
17.8 Confidentiality of Communication
Customers acknowledge that any communication, conversations, messages, or exchange of information with GloEPoint Worldmart through official channels are considered confidential and may not be shared publicly without written permission from GloEPoint Worldmart.
Any sharing of such communications on social media or other public platforms may be considered a breach of the Terms & Conditions and may result in legal action.
18. LAW & COURTS
18.1 Applicable Law
These Terms & Conditions are governed by and construed in accordance with the laws of Negara Brunei Darussalam, without regard to conflict of law principles. Customers agree that Brunei law is valid and enforceable even if the customer is outside the country.
18.2 Court Jurisdiction
Any dispute, claim, or legal action arising from these Terms & Conditions or related to the use of GloEPoint Worldmart services and products shall be brought to the relevant courts in Negara Brunei Darussalam only.
Customers agree to submit to the exclusive jurisdiction of the Brunei courts and waive any rights to bring disputes to courts in other countries.
18.3 Dispute Resolution
Any dispute, claim, or complaint shall be resolved through amicable negotiation directly between the customer and GloEPoint Worldmart first.
If negotiations do not reach a resolution within a reasonable period, the dispute may be brought to the relevant courts in Negara Brunei Darussalam according to the laws and jurisdiction stated.
18.4 Acknowledgment & Compliance
Customers acknowledge that they understand and agree that they are bound by these Terms & Conditions and any changes made by GloEPoint Worldmart.
If any provision in these Terms & Conditions is deemed invalid or unenforceable by a court, the other provisions will remain valid and fully enforceable.
CLOSING
By making a purchase, you hereby confirm and acknowledge that:
1. You have read, understood, and agree to be fully bound by these Terms & Conditions.
2. You have the responsibility to understand the contents of these Terms & Conditions before making any purchase or transaction.
GloEPoint Worldmart reserves the right to amend, modify, or add to these Terms & Conditions at any time without prior notice to customers. Such changes will take effect as soon as they are displayed on the official platform or officially announced by GloEPoint Worldmart.
Continued use, repurchase, or any transaction after such changes will be considered full acceptance of the updated Terms & Conditions, even if you no longer receive direct notices or notifications.
You also acknowledge that your failure to read or understand these Terms & Conditions is your own responsibility (your negligence), and is not a reason to make claims, lawsuits, or any legal action against GloEPoint Worldmart.
